Court Could Curb Coal Emissions -- But Will It?

After years of increased annual emissions from eight coal powered power plants operated by Duke Energy, the Supreme Court may finally require the company to increase its use of modern pollution controls. And under any rational reading of the Clean Air Act, it should. Two circuit courts have certainly seen it that way. The case will be argued tomorrow, but as the Charlotte Observer notes, a decision will probably take months. Tune in later this week for coverage of the argument.
