Update: Sixth Circuit 'Choose Life' License Plate Case May Be Headed to Supremes

Several weeks ago, we reported on a controversial Sixth Circuit decision authorizing the state of Tennessee to produce "Choose Life" license plates proposed by anti-abortion groups while rejecting a similar proposal for pro-choice plates by abortion rights supporters. Perhaps recognizing the questionable soundness of placing its imprimatur on state-sponsored viewpoint discrimination, the Sixth Circuit now has barred Tennessee from producing the Choose Life plates while its ruling is appealed to the U.S. Supreme Court. Howard Bashman at law.com predicts the Supremes will take the case and overturn the Sixth Circuit.
