If unions cannot recover from non union members for the cost of negotiations that inure to the latter's benefit, do not they have a right to collect on the basis of unjust enrichment? Has that argument been made in the "free ride" discussions? Does it mean that the unions can negotiate contractual benefits for their members, and in the negotiations fight as part of the settlement to ensure that the same benefits are not provided to non union members? Given the sophistication of our society today compared to that when unions were a greater force to be reckoned with, isn't it possible that such a strategy would in fact be operative, and that by doing so the unions can salvage a victory by showing the non union members the error of their ways? "Free riding", after all, has been effectively instituted in many union controlled areas buy declaring certain positions "management/confidential" and thus exempting those in those position from any form of union obligations. It seems to me that if the antiunion forces seek to take too much advantage of this apparant loophole, they could end up instituting a two tier system that will attract more workers to union membership as opposed to maintaining the status quo by continuing to demand compensation from non union members for the cost of benefits they cannot deny the union gained for them.In addition, of course, it will exacerbate workplace animosities as union members come to resent the free riders.OldLeftiehttps://www.blogger.com/profile/01326546638428398515noreply@blogger.comtag:blogger.com,1999:blog-3490776317263268706.post-70088259327992432992012-06-23T15:33:07.225-04:002012-06-23T15:33:07.225-04:00The renegade majority that have seiged our Soverei...The renegade majority that have seiged our Sovereign Supreme Court are in violation of our Constitutional Rights by trying to silence collective bargaining members which the renegade Court majority is an extension of the attempt of the Republican Party (One Percent/Tea Party control) to overthrow the Government of the Sovereign People of The United States of America. It is The People responsibility to take back their (our) Country. It time to investigate, indict, and prosecute anyone that is trying outlaw control our Constitution, in the effort to rule our Nation. It was not the 29million that allowed a criminal person, who sabotaged voting outcomes which brought charges against his top assistance and began the investigation against himself (Scott Walker). He won the recall because of the misinformed/miseducation of The People. People don't take into consideration that Collective Bargaining, today is paralleled to our Continental/Militia Army that defeated the tyrant British Empire during the Revolutionary War. If it wasn't for collective bargaining we would have a Middle Class and the opportunity to elevate from the Poor ranks and move into a life of descency as promised by President Franklin D. Roosevelt that said it is the right of The People to have a home and two cars in the garage... Reverend Ira L Lewis, Austin, TX trirason@gmail.com. The rash of pro-corporate decisions they have handed down recently shows it.riderdownhttps://www.blogger.com/profile/12748643150109705490noreply@blogger.com
